MissionGiveSM Terms of Service
Welcome to MissionGiveSM ("MissionGiveSM", "we," "our," or "us"). MissionGiveSM is a for-profit online platform owned and operated by MissionGive℠ LLC, designed to facilitate charitable giving by connecting donors with 501(c)(3) nonprofit organizations.
Please read these Terms of Service ("Terms") carefully before using the MissionGiveSM website (the "Site") or any of our services (collectively, the "Services"). By accessing or using MissionGiveSM, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Site.
1. Eligibility
To use MissionGiveSM, you must:
- Be at least 18 years old or the age of majority in your jurisdiction.
- Have the legal capacity to enter into binding agreements.
- Not be barred from using the Services under any applicable laws.
2. MissionGiveSM Services
2.1 For Donors
MissionGiveSM allows individuals to make charitable contributions to participating 501(c)(3) organizations ("Charities"). Donors:
- May contribute anonymously or choose to share their information.
- Will receive a donation receipt issued on behalf of the receiving charity for tax purposes.
- Understand that MissionGiveSM is not a nonprofit and acts as an intermediary.
2.2 For Charities
Eligible Charities:
- Must be recognized by the IRS as a valid 501(c)(3) organization.
- Must complete a verification process to receive disbursements.
- Agree to the platform's disbursement schedule and any applicable processing or service fees.
- Must accept that MissionGiveSM provides donation receipts on their behalf and support this legally.
3. User Accounts
You may create a user account to track donations and manage preferences. You are responsible for:
- Keeping your account information accurate and up to date.
- Safeguarding your password and account access.
- Notifying us of any unauthorized use of your account.
We reserve the right to suspend or terminate any account for violation of these Terms or misuse of the platform.
4. Fees and Payment Processing
4.1 Payment Processor
All donations are processed through a third-party payment provider. By donating, you agree to their terms of service and privacy policy.
4.2 Fees
Donations may include:
- Transaction fees charged by the payment processor.
- Platform fees retained by MissionGiveSM for providing services. Donors may choose to cover these fees or deduct them from the donation amount.
All fees will be disclosed prior to donation confirmation.
5. Tax Information and Receipts
- Donors will receive a year-end summary and/or individual receipts, issued on behalf of the designated 501(c)(3).
- MissionGiveSM is not a tax advisor and makes no guarantees regarding the deductibility of your donation.
- It is your responsibility to consult with a qualified tax professional.
6. Charity Verification and Conduct
Charities must:
- Maintain active 501(c)(3) status with the IRS.
- Provide accurate banking and contact information.
- Acknowledge that donations are made via a third party and that donor data may be anonymized.
We reserve the right to remove or suspend any Charity for misrepresentation, misuse of funds, or other violations.
7. Prohibited Conduct
You agree not to:
- Use the platform for any fraudulent, illegal, or unauthorized purpose.
- Impersonate another person or entity.
- Collect or store personal data of other users.
- Attempt to interfere with the operation of the Site or Services.
8. Intellectual Property
All content on the Site, including but not limited to text, graphics, logos, and software, is the property of MissionGiveSM or its licensors and is protected by intellectual property laws. You may not reproduce, modify, or distribute any part of the Site without prior written permission.
9. Disclaimers and Limitation of Liability
9.1 No Guarantee
MissionGiveSM makes no guarantees regarding the performance, outcome, or tax treatment of donations. We do not guarantee that any Charity will use donations as intended.
9.2 Platform Use
The Site and Services are provided "as is" without warranty of any kind. We disclaim all warranties, express or implied, including but not limited to:
- Availability or reliability of the platform;
- Accuracy of Charity information;
- Security of donation transactions.
9.3 Limitation of Liability
To the fullest extent permitted by law, MissionGiveSM shall not be liable for any indirect, incidental, special, or consequential damages arising out of or relating to:
- Use or inability to use the platform;
- Delays or failures in donation disbursements;
- Errors in tax documentation.
10. Indemnification
You agree to indemnify, defend, and hold harmless MissionGive℠ LLC and their officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, and expenses arising out of:
- Your use of the Site or Services;
- Violation of these Terms;
- Violation of any rights of a third party.
11. Modifications to Terms
We reserve the right to update or modify these Terms at any time. Changes will be posted to this page with an updated date. Your continued use of the platform constitutes acceptance of any changes.
12. Termination
We may suspend or terminate your access to the Services at any time, for any reason, including if we believe you have violated these Terms.
13. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved:
- Through informal negotiation first;
- If unresolved, by binding arbitration under AAA rules;
- Venue shall be Harrisburg, Pennsylvania.
